• Digital Marketing: Facebook advertising, social media management, and online campaigns

2.2 Service Delivery

Our services are delivered according to agreed timelines, specifications, and milestones as outlined in individual project agreements. We follow Agile development methodologies and provide regular progress updates.

2.3 Third-Party Integrations

Our services may include integrations with third-party platforms including but not limited to Facebook, Google, AWS, Firebase, and payment processors. Use of these integrations is subject to their respective terms of service.

3. User Obligations and Acceptable Use

3.1 Compliance

You agree to:

• Provide accurate and complete information when engaging our services
• Comply with all applicable laws and regulations
• Respect intellectual property rights of AppSolutions and third parties
• Use our services only for lawful purposes
• Maintain confidentiality of any login credentials or access codes

3.2 Prohibited Activities

You may not:

• Use our services for illegal, harmful, or fraudulent activities
• Attempt to breach our security systems or access unauthorized areas
• Reverse engineer, decompile, or attempt to extract source code from our solutions
• Share proprietary information without written consent
• Interfere with the proper functioning of our services or systems
• Use our services to spam, harass, or harm others

4. Payment Terms

4.1 Pricing and Payment

• Project-Based Pricing: Fixed costs for defined project scope
• Hourly Billing: Time and materials billing for ongoing work
• Retainer Agreements: Monthly recurring fees for ongoing services
• Payment Schedule: As specified in individual project agreements

4.2 Payment Processing

We accept various payment methods including bank transfers, credit cards, and digital payment platforms. Payment terms are typically NET 30 unless otherwise specified.

4.3 Late Payments

Late payments may result in service suspension and may incur additional fees. We reserve the right to charge interest on overdue accounts at a rate of 1.5% per month.

4.4 Refunds

Refund policies are specified in individual project agreements. Generally, work completed in good faith is non-refundable, but we may offer partial refunds for unused portions of prepaid services.

5. Intellectual Property Rights

5.1 Client IP Rights

Upon full payment, clients receive appropriate rights to deliverables as specified in project agreements. This typically includes:

• Source code ownership for custom applications
• Design files and assets created specifically for the client
• Rights to use and modify delivered solutions

5.2 AppSolutions IP Rights

AppSolutions retains rights to:

• Proprietary development frameworks and methodologies
• General knowledge, techniques, and know-how
• Pre-existing code libraries and tools
• The right to use project experience in case studies and portfolios

5.3 Third-Party Rights

Some solutions may incorporate third-party libraries, frameworks, or services subject to their respective licenses. Clients are responsible for compliance with third-party licensing terms.

6. Limitation of Liability and Warranties

6.1 Service Warranties

AppSolutions warrants that:

• Services will be performed with professional skill and care
• Deliverables will substantially conform to agreed specifications
• We will remedy material defects reported within 90 days of delivery

6.2 Disclaimer of Warranties

EXCEPT AS EXPRESSLY STATED, ALL SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

6.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APPSOLUTIONS' TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY CLIENT FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM. WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

6.4 Force Majeure

AppSolutions shall not be liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, government actions, pandemics, or infrastructure failures.

7. Privacy and Data Protection

7.1 Privacy Policy

Our handling of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

7.2 Data Security

We implement appropriate technical and organizational measures to protect client data, but cannot guarantee absolute security. Clients are responsible for maintaining backups of their data.

7.3 Data Processing

For clients in regulated industries or jurisdictions, additional data processing agreements may be required to ensure compliance with applicable privacy laws.

8. Social Media and Marketing

8.1 Facebook Marketing Services

Our digital marketing services may include Facebook advertising and social media management, subject to:

• Facebook's Terms of Service and Advertising Policies
• Client approval of all advertising content and campaigns
• Compliance with applicable advertising laws and regulations
• Performance metrics as agreed in marketing service agreements

8.2 Content Rights

Clients grant AppSolutions necessary rights to create, publish, and manage marketing content on their behalf. All content must comply with platform policies and applicable laws.

9. Confidentiality

9.1 Mutual Confidentiality

Both parties agree to maintain confidentiality of proprietary information shared during the business relationship, including:

• Business strategies and plans
• Technical specifications and designs
• Financial information
• Customer data and business relationships

9.2 Exceptions

Confidentiality obligations do not apply to information that is publicly available, independently developed, or required to be disclosed by law.

10. Termination

10.1 Termination Rights

Either party may terminate ongoing services with written notice as specified in individual agreements. Project-based work continues until completion unless terminated for cause.

10.2 Effect of Termination

Upon termination:

• All outstanding payments become immediately due
• AppSolutions will deliver work completed to date
• Confidentiality obligations continue
• Access to AppSolutions systems and tools will be revoked

11. Dispute Resolution

11.1 Informal Resolution

We encourage clients to contact us directly to resolve any concerns or disputes informally before pursuing formal legal action.

11.2 Governing Law

These Terms are governed by the laws of Palestine and the applicable international commercial law. Any disputes will be resolved through arbitration or in the courts of Ramallah, Palestine.

11.3 Limitation Period

Claims must be brought within one (1) year of the date when the claim first arose.

12. General Provisions

12.1 Modifications

AppSolutions may update these Terms from time to time. Material changes will be communicated to active clients, and continued use of services constitutes acceptance of updated Terms.

12.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

12.3 Assignment

Clients may not assign their rights under these Terms without written consent. AppSolutions may assign these Terms in connection with a business transfer or acquisition.

12.4 Entire Agreement

These Terms, together with any executed agreements and our Privacy Policy, constitute the entire agreement between the parties regarding the subject matter herein.
